The Supreme Court has ordered the Commission on Elections (Comelec) to proclaim former Vice Mayor Shirlyn Bañas-Nograles as the duly elected representative of the First District of South Cotabato, including General Santos City, in the recent May polls.
Voting 14-0, the high tribunal declared Comelec Resolution 10524 null and void and ruled that Nograles won in the elections where she garnered 194,929 votes out of the 284,351 votes cast for South Cotabato’s first congressional district.
The poll body had suspended the election for the representative of first district of South Cotabato following the passage of Republic Act No. 11243 or An Act Reapportioning the First Legislative District of the Province of South Cotabato, which took effect on April 4, almost a month before the May 13 elections.
“Wherefore, the instant petition is hereby granted. Comelec Resolution no. 10524 is hereby declared null and void. The elections for the representative of the First Legislative District of South Cotabato, including General Santos City, be upheld,” the Court said.
