Unlike frustrated senator Greco Belgica, Negros Oriental Governor Roel Degamo knows that he can’t just file a complaint against Ombudsman Conchita Carpio Morales.
Degamo excluded Morales in the graft complaint he filed before the Department of Justice (DOJ) against officials and prosecutors of the Office of the Ombudsman.
“The Honorable Ombudsman Conchita Carpio Morales is not impleaded considering that she is an impeachable officer,” read his complaint that was filed Wednesday (March 29).
On Tuesday (March 28), the Supreme Court (SC) dismissed the disbarment complaint filed by Belgica against Morales.
The High Tribunal stated that “a public officer who under the Constitution is required to be a member of the Bar as a qualification for the office held by him/her and who may be removed from office only by impeachment cannot be charged with disbarment during the incumbency of the public officer.”
